1. Acceptance of Terms

By accessing or using Apoet ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Service. Apoet reserves the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.

2. Eligibility

You must be at least 13 years old to use Apoet. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements. Users in regions with different age requirements must comply with local laws.

3. Account Registration

To access certain features, you must create an account using Google Sign-In. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Not share your account with others

4. User Content

"User Content" includes poems, stories, tales, comments, profile information, and any other content you submit. By posting User Content, you:

• Retain ownership of your original content
• Grant Apoet a worldwide, non-exclusive, royalty-free license to use, display, distribute, and promote your content on the platform
• Represent that you have the right to publish such content
• Agree that your content may be viewed by other users

5. Prohibited Content & Conduct

Detailed rules about what you can and can't publish are in our Content Policy, and rules about how we treat each other are in our Community Guidelines. In summary, you agree NOT to post or engage in:

• Content that infringes copyrights, trademarks, or other intellectual property rights
• Plagiarized or AI-generated content presented as original work without disclosure
• Sexually explicit or pornographic content
• Content promoting self-harm, suicide, or violence
• Hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Bullying, threats, or intimidation of other users
• Spam, commercial solicitation, or misleading content
• Content that exploits or endangers minors
• Malware, phishing, or attempts to compromise user security
• Impersonation of others or misrepresentation of identity

6. Content Moderation

Apoet reserves the right to review, remove, or disable access to any content that violates these terms. Content may be placed under review, archived, or deleted at our discretion. Users may report content they believe violates our guidelines. False or malicious reports may result in action against the reporting account.

7. Intellectual Property

The Apoet platform, including its design, features, logos, and branding, is owned by Apoet and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without written permission.

8. Premium Features, Coins & Purchases

8.1 Premium Subscriptions

Apoet offers optional premium subscriptions (monthly or yearly) that unlock additional features. Subscriptions auto-renew at the end of each billing period unless cancelled before renewal. You can manage or cancel subscriptions at any time through your Google Play or App Store account settings. Features included in premium may be added, modified, or removed at our discretion.

8.2 Coins (Virtual Currency)

"Coins" are a virtual, in-Service currency used to send gifts to other users. Coins can be acquired in two ways:

• Purchase: Buy coin packs at displayed prices through Google Play, App Store, or other supported payment methods
• Earnings: When another user sends you a gift, a portion of the gift's coin value (currently 80%) is credited to your balance

Coins can only be used within Apoet to send gifts. Coins cannot be transferred between accounts, traded, sold, gifted as raw coins, or converted to cash or any other currency. The exchange rate between gift value and earned coins is set by Apoet and may change with reasonable notice.

8.3 Platform Billing

All purchases of coins and subscriptions are processed by the platform you bought through (Google Play Billing, Apple App Store, or our payment provider for web). Those platforms' billing terms apply in addition to these Terms. Apoet does not directly receive or store your payment card details.

8.4 No Real-World Value

Coins, gifts, badges, and other virtual items have no real-world monetary value. They are a license to use specific in-app features, not your property. You have no ownership interest in them, and Apoet may modify, limit, suspend, or discontinue them at any time, with reasonable notice where practicable. Coins do not earn interest, do not accrue value, and cannot be inherited or transferred to another account.

8.5 No Withdrawal or Cashout

Coins received from gifts cannot be withdrawn, cashed out, or exchanged for currency, goods, or services outside Apoet. If Apoet introduces a creator payout or monetization program in the future, that program will have its own separate terms and eligibility criteria.

8.6 Taxes

Prices shown may or may not include applicable taxes depending on your region. The platform processing your purchase (Google Play, App Store, or our web payment provider) is responsible for calculating and collecting any required taxes based on your billing location.

8.7 Eligibility & Availability

Purchases may not be available in all countries. You must be of legal age to enter into a contract in your jurisdiction (or have parental/guardian consent where permitted by the platform). Platform store age and account requirements apply.

8.8 Pricing Changes

Apoet may change the price, contents, or availability of coin packs and subscriptions at any time. Existing purchases are not affected by future price changes; new prices apply only to subsequent purchases.

9. Refunds

All coin and subscription purchases are final and non-refundable except where required by applicable consumer-protection law or store policy.

• Google Play purchases: Refund requests are handled per Google Play's refund policy
• App Store purchases: Refund requests are handled per Apple's refund process
• Web purchases: Contact us at support@apoet.co. EU/UK consumers may have a 14-day right of withdrawal; this right is generally lost once digital coins are delivered to your account, which you expressly consent to by purchasing

If a refund is granted, the corresponding coins (or any remaining bonus coins from that pack) will be deducted from your balance. If your balance is insufficient, the deficit may be carried against future earnings or restrict your ability to send gifts until resolved.

Filing a chargeback or payment dispute without first contacting us may result in temporary or permanent suspension of your account and forfeiture of remaining coins, pending resolution.

10. Account Suspension & Termination

We may suspend or terminate your account if you violate these terms, engage in prohibited conduct, or for any other reason at our discretion. Upon suspension or termination:

Account action may include a soft ban, suspension, or permanent ban. A soft ban limits selected features such as posting, commenting, messaging, discovery, or uploads while keeping some account access available. A suspension temporarily locks account access. A permanent ban closes the account and revokes access to the Service.

• Your access to the Service will be revoked
• Your content may be removed or hidden
• Any remaining coin balance, premium time, or other virtual goods are forfeited and non-refundable
• Active subscriptions must be cancelled by you through the originating store; Apoet cannot cancel store-billed subscriptions on your behalf

Ban evasion, including creating or using another account to bypass a restriction, may lead to a permanent ban.

You may delete your account at any time through Settings > Privacy & Security. Deleting your account also forfeits any unused coins and premium time.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. Apoet does not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for User Content or the conduct of any users.

12. Limitation of Liability

To the maximum extent permitted by law, Apoet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to Apoet in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Apoet, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your User Content, or your violation of these terms.

14. Third-Party Services

Apoet uses third-party services including Google Firebase for authentication and storage. Your use of these services is subject to their respective terms and privacy policies. Apoet is not responsible for the practices of third-party services.

15. Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

16. Changes to Terms

We may update these terms from time to time. We will notify users of significant changes through the app or email. Your continued use after changes constitutes acceptance of the updated terms.
